29 CFR 1926.502(d)(15): Anchorage used for attachment for personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached nor was it designed, installed and used as follows: As part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person: a) 2650 Patterson Plank Road, 8th Floor Eastside of building, North Bergen, NJ. Employee was observed using a personal fall arrest system that was attached to cold formed metal studs, thereby exposing the employee to approximately fall hazard of 40 feet to the balcony below. Violation observed on or about 05/15/2013

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level: a) 2650 Patterson Plank Road, 8th Floor East side of building, North Bergen, NJ. Employee observed wearing personal fall arrest system that was attached to cold formed metal studs. The employee was attached to a rope with a shock absorbing lanyard on both sides, thereby exposing the employee to an approximately 40 foot fall hazard to the balcony below. Violation observed on or about 05/15/2013.
