OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to crushing hazards:    On or about May 30, 2013, in Shipping/Receiving:  An employee was observed operating the Nissan 50 propane powered industrial truck without the provided seatbelt.

29 CFR 1910.23(a)(8): Every floor hole into which persons could accidentally walk was not guarded by either a standard railing with standard toeboard on all exposed sides, or a floor hole cover of standard strength and construction.  While the cover was not in place, the floor hole was not constantly attended by someone or protected by a removable standard railing:   On or about May 30, 2013 near the CN#3 lift station, the diamond plate floor hole cover had been removed, leaving a 14" wide x 28" wide floor opening for access to a steam line in the walkway.  The opening was not attended or protected by a standard railing, exposing employees to trip and fall hazards.

29 CFR 1910.303(b)(1): Electrical equipment was not free from recognized hazards that were likely to cause death or serious physical harm to employees:   On or about May 30, 2013 at the D-1 Degreaser:  A reel drop had a damaged electrical cord which was used to power the CM Lodestar 1/2-ton hoist.  Employeees were exposed to electric shock hazards.

29 CFR 1910.303(g)(1)(ii): The required working space about electric equipment rated 600 volts, nominal, or less to ground, was used for storage:   On or about May 30, 2013, in the following locations, the employer used the working space in front of electrical equipment for storage:  A.  Chrome Line near entrance:  At the Empire F002, a metal basket and two plastic trash barrels were blocking an array of disconnects labeled "Feed for small 3-phase," "nickel blower," and "Chrome."  B.  Silver Line near exit:  The work space in front of two 240V electrical panels was used for the storage of chemical containers, parts and a plastic tarp.

29 CFR 1910.305(g)(1)(iii): Flexible cords and cables were used for purposes prohibited by subparagraphs (A) through (E) of this paragraph:      On or about May 30, 2013, in the following locations, flexible cords were used in lieu of the fixed wiring of the building:    A.  Chrome Line, at the M-4 Metex Acid Salt M-629 Tank:  A flexible extension cord was used to power a Flo King, Model BX 1200 pump.    B. Silver Line, at the Silver Strike (Rack) #1:  A flexible extension cord was used to power a Flo King, Model BX 1200 pump.    C.  Shipping/Receiving:  The battery for a Yale pallet jack was being recharged through a flexible extension cord.
