29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary. At this job site where backfill of a trench was occurring a two man crew was instructed to remain in the trench while a John Deere excavator was being used to backfill the trench. The excavator was operated while it was placed on a road plate at the top of the trench. The employees were exposed to the following hazardous conditions: A. The road plate used to bridge the width of the trench could have slid and fallen into the trench as a result of the movement of the excavator's tracks and struck the employees. B. The operator of the excavator could have made a faulty judgement regarding the position of the excavator's tracks and thus could have moved the excavator such that it would have gone over either side of the road plate and struck the employees in the trench.
