29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder:   a) Texsand Energy Resources, LLC, at 4390 Madison Street, Denver, CO: On and before June 4, 2013 the employer did not ensure employees accessing the tops of bins/silos were protected from fall hazards via conventional fall protection or a standard guardrail system.  This condition exposed employees to a fall hazard in excess of 30 feet.

29 CFR 1910.1000(c): Employees were exposed to crystalline silica in excess of the 8-hour time weighted average limits listed in Table Z-3:   a) Texsand Energy Resources, LLC, at 4390 Madison Street, Denver, CO: On and before June 4, 2013 employee exposure to a substance listed in Table Z-3 exceeded the 8-hour Time Weighted Average (TWA) for that substance.  On June 4, 2013 Employee A, involved in removing/shoveling sand from bins, was exposed to respirable silica at a concentration greater than the 8-hour TWA Permissible Exposure Limit (PEL) of 0.2778 mg/m3.  The employee was exposed to respirable silica at a concentration of 1.32 mg/m3 as an 8-hour TWA.  This is approximately 4.8 times the PEL.  Air monitoring was conducted for 382 minutes.  This condition exposed employees to respiratory hazards such as silicosis.   b) Texsand Energy Resources, LLC, at 4390 Madison Street, Denver, CO: On and before June 4, 2013 employee exposure to a substance listed in Table Z-3 exceeded the 8-hour Time Weighted Average (TWA) for that substance.  On June 4, 2013 Employee B, involved in removing/shoveling sand from bins, was exposed to respirable silica at a concentration greater than the 8-hour TWA Permissible Exposure Limit (PEL) of 0.2439 mg/m3.  The employee was exposed to respirable silica at a concentration of 1.1602 mg/m3 as an 8-hour TWA.  This is approximately 4.8 times the PEL.  Air monitoring was conducted for 375 minutes.  This condition exposed employees to respiratory hazards such as silicosis.   c) Texsand Energy Resources, LLC, at 4390 Madison Street, Denver, CO: On and before June 4, 2013 employee exposure to a substance listed in Table Z-3 exceeded the 8-hour Time Weighted Average (TWA) for that substance.  On June 4, 2013 Employee C, involved in removing/shoveling sand from bins, was exposed to respirable silica at a concentration greater than the 8-hour TWA Permissible Exposure Limit (PEL) of 0.2439 mg/m3.  The employee was exposed to respirable silica at a concentration of 1.4372 mg/m3 as an 8-hour TWA.  This is approximately 5.9 times the PEL.  Air monitoring was conducted for 381 minutes.  This condition exposed employees to respiratory hazards such as silicosis.  Texsand Energy Resources, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 507658, citation number 1, item number 3a and was affirmed as a final order on October 18, 2012, with respect to a workplace located at 4390 Madison St. Denver, CO 80216.

29 CFR 1910.134(g)(1)(i)(A): The employer permitted respirators with tight-fitting facepieces to be worn by who have facial hair that comes between the sealing surface of the facepiece and the face:     (a) Texsand Energy Resources, LLC, at 4390 Madison Street, Denver, CO: On and before June 4, 2013 , the employer allowed employees who are required to wear respirators to have facial hair.  The employer allowed employees who manually move silica sand to wear tight-fitting half-face respirators.  This condition exposes employees to inhalation of crystalline silica due to poorly sealed respirators.  Texsand Energy Resources, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 507658, citation number 1, item number 3h and was affirmed as a final order on October 18, 2012, with respect to a workplace located at 4390 Madison St. Denver, CO 80216.
