29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.    a) Jobsite: 331 Clayton Manor Drive, Middletown, DE - Employees were conducting roofing activities and were using a yellow extension ladder for access to the roof which was extended less than 2' above the landing surface.    b) Jobsite: 331 Clayton Manor Drive, Middletown, DE - Employees were conducting roofing activities and were using an orange extension ladder for access to the roof which was extended less than 1' above the landing surface.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) Jobsite: 331 Clayton Manor Drive, Middletown, DE-Employees were observed working on the roof of a residence approximately 15-25 feet from ground level without fall protection training. On or about 5/30/13.  Pursuant to 29 CFR 1903.19, the employer must submit abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) Jobsite: 331 Clayton Manor Drive, Middletown, DE - Employees were observed working on the roof of a residence approximately 30' above ground level without fall protection. On or about 5/30/13.    SM Contractors, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 311812002, citation number 1, item number 1 and was affirmed as a final order on 03/06/12, with respect to a workplace located at 215 New Road, Elsmere, DE.
