29 CFR 1926.451(g)(4)(ii): The top edge height of toprails or equivalent members on all supported scaffolds were not installed between 38 inches (0.9 m) and 45 inches (1.2 m) above the platform surface:  a) Wine on the 9, 6531 U.S. 9, Howell, NJ 07731: On or about May 10, 2013, an employee was exposed to fall hazards of approximately 13.5ft while working from a scaffold without adequate guardrails. The toprail was installed at 35in above the platform.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

Employees were exposed to falls of approximately 6ft and 13.5ft.  M.H. CONTRACTOR, INC.
