Broadway, Long Beach NY- An employee was not wearing a protective helmet and was exposed to being struck by asphalt shingles and tools while walking and working below overhead roofing work; on or about 05/31/13. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. a) Worksite, 400 W. Broadway, Long Beach NY - Employees were removing and replacing asphalt shingles on the roof of a four story condominium. The employees were not protected from falling approximately 40ft to the ground below; on or about 05/31/13. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19. Int Ext Construction Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 1926.501(b)(13), which was contained in OSHA inspection number 313431355 citation number 1, item number 2 and was affirmed as a final order on 9/20/11, with respect to a workplace located at 46-11 Marathon Parkway Little Neck, NY 11362.
