OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while performing work around damaged racks. On or about May 30, 2013, employees were exposed to struck-by hazards while performing work around damaged racks. The employer failed to regularly inspect rack systems for damage and replace or repair damaged racks. The following racks were damaged: a. Support post in mold storage area in breezeway between production and skid warehouse b. Support post in the skid warehouse in the product racks at location 25 c. Support post in the skid warehouse in the product racks at location FPP7B AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THESE HAZARDS IS: 1. The employer shall follow American National Standard Institute (ANSI) MH16.1:2008, Specification for the Design, Testing, and Utilization of Industrial Storage Racks, Section 1.4.1(2), which states, "The owner shall maintain the structural integrity of the installed rack system by assuring proper operational housekeeping and maintenance procedures 2. Regularly inspect for damage. If damage is found, immediately unload the affected area and replace or repair any damaged columns, beams, or other structural components.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: On or about May 29, 2013, employees were exposed to chemical hazards when the employer did not provide temporary employees information on the location of the program and MSDS, or employee training. Employees were exposed to chemicals such as, but not limited to, polystyrene, salt water, and thickening agents (polar pack).
