29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    (a) Walking Top Plate -  The employer permitted an employee with no fall protection to walk the top plate while setting trusses.  The employee was exposed to a fall of 9 feet 6 inches from the top plate to the concrete floor below on or about May 30, 2013.    (b) Working In Trusses - The employer permitted an employee with no fall protection to work inside the trusses to install a 2 X 4 "cat walk" along the bottom of the truss system. The employee was exposed to a fall of 10 feet from the trusses to the concrete floor below on or about May 30, 2013.     Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed:       (a) Walking the Top Plate - An employee used the top two steps of an 8 foot step ladder to climb onto the top plate of the structure to set trusses.  The employee was exposed to a fall of between 8 feet and 9 feet 6 inches to the concrete surface below the ladder on or about May 30, 2013.       (b) Working in Trusses - An employee used the top two steps of an 8 foot step ladder to climb into the truss system to work installing the 2 X 4 "cat walk".  The employee was exposed to a fall of between 8 feet and 10 feet to the concrete surface below the ladder on or about May 30, 2013.         (c) South Side of Building - An employee worked from a folded 6 foot step ladder that was leaning on the exterior wall of the structure to seal the weather wrap around the windows.  The employee did not use the ladder in a manner intended by the manufacturer and exposed to a fall of 4 feet from the ladder to the ground below on or about May 30, 2013.         Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.       The Quality Production Construction was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 311681894, citation number 1, item number, 5 and was affirmed as a final order on November 23, 2009, with respect to a workplace located at Five Forks Drive, Harpers Ferry West Virginia.
