29 CFR 1910.1200(e)(2)(ii): The employer's hazard communication program did not include methods the employer will use to inform the other employer(s) of any precautionary measures that need to be taken to protect employees during the workplace's normal operations and in foreseeable emergencies:     (a)  On or about March 25, 2013, the employer did not warn contractor employees of the dangers of a steam leak and a sump pump malfunction that caused reduced visability in the rail yard and high levels of waste water in the drainage ditch.  As a result of this, a contractor employee accidentally stepped on the grating covering the drainage ditch and fell into the 180 degree F waste water and tallow when the grating slipped.  The employee received third degree burns to his right leg.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
