OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard.    On or about May 28, 2013, an employee was driving the F-650 bucket truck down the southbound easement of Highway 290 West while an employee was elevated in the bucket up to approximately 15 feet high without maintaining two-way radio communication, exposing the employee to a fall hazard.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that two-way intercom communication is maintained between the driver and the employee in the bucket while the vehicle is moving.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:     On or about May 28, 2013, an employee was pulling cable from an elevated position in the bucket truck up to approximately 15 feet high without fall protection, exposing the employee to a fall hazard.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee working from an elevated position in a bucket truck is provided and required to use fall protection.

Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee working from an elevated position in a bucket truck is provided fall protection training.
