29 CFR 1926.200(g)(2): All traffic control signs or devices used for protection of construction workers shall conform to Part VI of the Manual of Uniform Traffic Control Devices (AMUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA, which are incorporated by reference. a) Trench in front of 134 Sylvan St.- Employees working in vehicular traffic did not follow standard MUTCD safety procedures. They were using two triangle safety reflectors to channel traffic; on or about 05/01/13.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. a) Inside the trench- Employees were accessing a ladder that did not extend 3 feet over the landing; on or about 05/01/13.

The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper that one and one-half horizontal to one vertical (34 degrees measured from the horizontal): a) Trench in front of 134 Sylvan Street- Employees working in a trench did not install shoring to protect them from a potential cave-in; on or about 5/1/13. Anthony Pizza was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 312862188, citation number 1, item number 1 and was affirmed as a final order on 1/5/10 with respect to a workplace located at 134 Sylvan Avenue, Rutherford, NJ 07070.
