29 CFR 1926.451(g)(4)(xv): Crossbracing used in place of a midrail was unacceptable because the crossing point of two braces was not between 20 inches (0.5 m) and 30 inches ((0.8 M) above the work platform or as a toprail crossing point of two braces were not between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform.  The endpoints at each upright were more than 48 inches (1.3 m) apart.     The employer does not install midrails on a scaffold when crossbraces are the toprails. This violation was observed on or about May 31, 2013, on the south side of a newly built apartment building where employees were exposed to a fall hazard when at a height of 15 feet without midrails.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that when crossbracing is used as a midrail or a toprail that a corresponding toprail or midrail is also installed.
