29 CFR 1926.403(b)(1)(i): Safety of equipment was not determined on the basis of suitability of the equipment for an identified purpose as evidenced by listing, labeling, or certification for that identified purpose:   a)  Basement - A plastic surge protector, designed for residential use, was used on a constitution project to provide temporary power to portable power tools, on or about 05/21/2013.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.403(i)(2)(i): Live parts of electric equipment operating at 50 volts or more were not guarded against accidental contact by cabinets or other forms of enclosures, nor by any of the means listed in subparagraph (A) through (D) of this paragraph:       a)  Basement - Masons were exposed to a 120 volt electrical shock hazard from a Cutler Hammer service distribution panel which was not provided with a cover that would protect the workers from accidentally coming in contact with 120 volt live parts, on or about 05/21/2013.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a)  Second Floor - Construction workers were exposed to a 14 foot fall through window openings that were not provided with fall protection, on or about 05/21/2013.

29 CFR 1926.1052(c)(1)(i): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail:    a)  Second Floor - Roofers and masons were exposed to a possible 10 foot fall hazard while traveling up and down a set of stairs that had not been provided with a handrail, on or about 05/21/2013.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
