29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person. a/ At the job site, on employees were using a mobile scaffold without the guardrails to install new Heating Ventilation Air Conditioning (HVAC) units. The employees were not trained in a safe erection and use of the scaffold. On 05/31/2013 one of the employees fell from the platform of the scaffold and died as the result of injuries. The height of the platform was 10 feet and 3 inches from the floor.

29 CFR 1926.454(a)(1): The employer failed to have each employee who performs work while on a scaffold trained regarding the nature of any electrical hazards, fall hazards and falling object hazards in the work area. a/ At the job site, employee(s) working from an unguarded, mobile scaffold were not trained to recognize and minimize the fall hazards involved with the use of this scaffold.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms: a/ At the job site, on or about 05/31/2013, an employee used a Bakers Mobile Scaffold to install HVAC units. The height of the working platform was measured at approximately ten feet and 3 inches from the floor. No standard guardrail system or the equivalent was in place. The employee fell from the scaffold platform to the concrete floor and was pronounced deceased as the result of his injuries.
