Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential tip over of powered industrial trucks:     (a)  On or about June 3, 2013, employees while operating Caterpillar forklift truck Model P5000, Serial No. AT3512660, were exposed to tipping over hazards were not utilizing the active operator protection device or system (seatbelts) when loading or unloading trailers without appropriate supports, such as jacks under the front of the trailers and portable dock plates not secured and centered.     (b)  On or about June 10, 2013, employees while operating Caterpillar forklift trucks Model P 5000, Serial No. AT3512660, were exposed to tipping over hazards were not utilizing the active operator protection device or system (seatbelts) when loading or unloading trailers without appropriate supports, such as jacks under the front of the trailers and portable dock plates not secured and centered.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.27(b)(1)(ii): The distance between rungs exceeded 12 inches and were not uniform throughout the ladder:  (a)  The fixed ladder on the mixing tank for the MBI-203 started 30 inches above the floor of the building and was bent in several places so the rungs were not uniform.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

(a)  The fixed ladder on the mixing tank for the MBI-203 was bent and appeared to have been hit by a forklift. (b)  On or about June 10, 2013, the eyewash station in the work area was filled with tools, so it was not available for immediate emergency use.  (c)  On or about July 19, 2013, the eyewash station in the work area was filled with tools and a plastic trash bag, so it was not available for immediate emergency use. 29 CFR 1910.1200(f)(6): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier, signal word, hazard statement(s), pictogram(s), precautionary statement(s) and name, address, and telephone number of the chemical manufacturer, importer, or other responsible party.  (a)  On or about June 10, 2013, two unlabeled plastic bottles were observed on a ledge beneath the electrical boxes on the south east side of the building near the tank that was mixing MBI-203.  The one bottle contained liquid stripper and the bottle without the lid contained water.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET)
