29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: or in the alternative; 1910.23(c)(1) Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. a) Shredder Machine/Feed Roll Drum Area - Employee accessed upper area of shredder machine to clear material from feed roll drum. Work height was approximately 10 feet above the lower surface and/or 18 feet to the ground. Worker was not protected from fall hazard through the use of personal fall arrest systems or a guardrail system; on, or about, 06/03/2013. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
