OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) William Floyd Parkway; Shirley, NY - Employees were riding on the cab guard of a GMC Bucket Truck used in tree service operations; on, or about, 06/04/2013. In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19. Abatement Note: Among other methods, one feasible and acceptable method to correct the hazard is to ensure that employees are not permitted to ride or work outside or on top of units unless the unit is designed for that purpose or the operator is performing maintenance or inspection in accordance with ANSI Z133.1-2006, Safety Requirements for Arboricultural Operations, Safe use of Vehicles and Mobile Equipment used in Arboriculture, 5.1.9.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: In the Alternative; 1910.23(c)(1) Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. a) William Floyd Parkway; Shirley, NY - Employees were working at heights of approximately 8 feet from the cab guard of a GMC Bucket Truck used in tree service operations; on, or about, 06/04/2013. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
