29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: On 6/3/2013, at the above addressed worksite, a heavy equipment operator had both of the excavator's torsion tracks at the edge of the excavation exposing employees inside the excavation to a caught-in-between and struck-by hazard.

29 CFR 1926.652(b)(4)(iii): At least one copy of the design was not maintained at the jobsite while the slope was being constructed. After that time the design need not be at the jobsite, but a copy shall be made available to the Secretary upon request: On 6/3/2013, at the above addressed worksite, employees were working inside a 6 foot excavation that the employer claimed it was stable rock, but did not have a copy of the sloping or benching design approved by a professional engineer at the work site during the time of the investigation.
