29 CFR 1910.26(c)(3)(vii): Portable ladders were used for other uses than that for which they were intended: a/ Inside of the yard, a portable step ladder was positioned adjacent to a fixed ladder attached to the Rotochopper RG-1 Machine. Employee(s) would climb up the stepladder then cross over to the fixed ladder to gain access to a platform on the machine. The fall distance to the ground below was approximately 57 inches.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a/ A written lockout/tagout program was not developed in writing that governed how machinery such as the Rotochopper RG-1 were to be isolated from all energy sources and how the use of lockout devices, periodic inspections, and employee training were to be managed.
