29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of job-sites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a)Noemar, LLC @ 3988 Mt. Hope St., Wellington, CO 80549: On and before June 5th, 2013, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontractor employees on-site were permitted to work in areas where fall hazards and impalement hazards existed. The condition exposed employees to fall hazards of approx feet and 10 feet. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement: (a) Noemar, LLC @ 3988 Mt. Hope St., Wellington, CO 80549: On and before June 5th, 2013, the controlling employer did not ensure subcontractor employees were protected from impalement hazards with exposed vertical rebar within a residential excavation while walking and working on the surface excavation. Subcontractor employees walked and worked near the edge of the excavation. The excavation was approximately 7 feet in depth. This condition exposed subcontractor employees to impalement hazards.
