29 CFR 1926.300(b)(2): Belts, gears, shafts, pulleys, sprockets, spindles, drums, fly wheels, chains, or other reciprocating, rotating, or moving parts of equipment exposed to contact by the employees or which otherwise created a hazard, were not guarded: a) At the site, where the air compressor pulley was unguarded. The employees used the air compressor to power the nail guns. This condition exposed the employees to a caught-in hazard.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend to at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access nor was the ladder secured at its top to a ridged support and a grasping device, such as a grabrail, provided to assist the employee in mounting and dismounting the ladder: a) At the site, where the employees used a Werner portable ladder to access the second level of a residential structure that was not extended at least three feet above the lower landing. This condition exposed the employees to a fall hazard.

JESUS REYNA WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD 29 CFR 1926.501(b)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 315721829, CITATION NUMBER 01, ITEM NUMBER 004 AND WAS AFFIRMED AS A FINAL ORDER ON SEPTEMBER 14, 2011, WITH RESPECT TO THE WORKPLACE LOCATED AT 2510 MURICIA, LEAGUE CITY, TEXAS 77573.
