29 CFR 1926.102(a)(1): Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents.  a. On or about June 5, 2013 - at the above addressed jobsite, employees using pneumatic nail guns to perform roofing operations did not wear safety glasses, thereby exposing employees to the eye injuries.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a.  On or about June 5, 2013 - at the above addressed jobsite, employees performing roofing operations approximately eleven (11) feet above the ground were not protected from falls, thereby exposing the employees to fall hazards.

29 CFR 1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  a. On or about June 5, 2013 - at the above addressed jobsite, the employer failed to provide a written certification record of training for each employee exposed to fall hazards.

29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a.  On or about June 5, 2013 - at the above addressed jobsite, the employer did not initiate and maintain an accident prevention program and/or safety and health program to comply with the regulations of this part which included, but were not limited to employee protection when exposed to falls.  THE DELGADO CONSTRUCTION, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.20(b)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 190886, CITATION NUMBER 1, ITEM NUMBER 1b AND WAS AFFIRMED AS A FINAL ORDER ON APRIL 16, 2012 WITH RESPECT TO A WORKPLACE LOCATED AT 800 SOUTH ILLINOIS ROUTE 31, CRYSTAL LAKE, IL  60014.
