29 CFR 1910.132(d)(1)(i): The employer did not select and have each affected employee use, the types of personal protective equipment that would protect the affected employee(s) from the hazards identified in the hazard assessment: Employees performing sand blasting tasks on rail cars in the Sandblasting Area were exposed to injury from falls of approximately 14 feet, from the top of the rail car(s) to the concrete/ground below. No fall protection was used by employees when accessing the top port holes to gain entry into the rail cars and while sand blasting on top of the rail cars. Rail Car Services LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1910.23(c)(1), which was contained in OSHA inspection number 331584, citation number 1, item number 1, and was affirmed as a final order on September 18, 2012.
