29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) On June 6, 2013 and at times prior thereto; front of residential home; employees were not wearing any head protection while working at the lower levels of the scaffold system or ground.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity). a) On June 6, 2013 and at times prior thereto; east side and north side of building, employees were observed working on a adjustable scaffold system (30 ft. from ground level) without a personal fall arrest system in place that would protect them from falling; such as railing and/or harness.
