Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: (a) On or about June 6, 2013, for the employee who was caught-in/crushed-by a Diamond Surface highway grinder where the equipment remains in operation after the operator leaves the control seat in the north bound lane of I-29, Mile Marker 151, in the vicinity of Manvel, North Dakota. Abatement Note: Among other methods, one feasible and acceptable method of abatement would be to follow the manufacturer's recommended practices for similar pieces of equipment owned by the company, such as the Diamond Products PC-6000EC Highway Grinder which states: "Never get off the machine for any reason during operation. SERIOUS INJURY OR DEATH COULD RESULT".

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) On or about June 6, 2013, for the employee who was caught-in/crushed-by a Diamond Surface highway grinder where the employer had instructed employees to leave the seat and take cutting path measurements, in front of the moving equipment, while in operation in the north bound lane of I-29, Mile Marker 151, in the vicinity of Manvel, North Dakota.
