OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:   In that below the hook lifting pins were used to lift parts on/off the vertical turret lathes and the lifting pins were not proof tested, rated, or marked with the safe working load limits or capacities. One feasible and useful method of abatement is to comply with ASME B30.20-2003, which requires that the lifting device be legibly marked with the rated load, the manufacturer's name and address, and the serial number. In addition, ASME B30.20-2003 requires under Section 20-1.2.2 Construction, that the load-bearing structural components of a lifting device be designed to withstand stresses imposed by its rated load plus the weight of the lifter, with a minimum design factor of three, based on the yield strength of the material.

29 CFR 1910.147(e)(3): Each lockout or tagout device was not removed from each energy isolating device by the employee who had applied the device:    (a) On or about June 10, 2013 and prior one maintenance employee toke off the lockout lock of another maintenance employee from another shift as the employee who applied the lock placed the key to the lock in the maintenance crib area (fenced enclosure) with a note with the key as to what had been done and/or what still needed to be done. They did not follow Section 7.4 on Shift or Personnel changes in the company's written Lockout/Tagout program.

(b) On or about May 12, 2013, a maintenance employee performed troubleshooting/voltage testing on 480 VAC 3 phase for the Toshulin vertical turret lathe machine and was not provided and did not wear appropriate personal protective equipment.
