OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck or crushed-by hazards: (a) 611 Burnside Avenue, Inwood, NY (Worksite), Material Yard - An employee was operating the Hyster H60 forklift, serial # D177B44673V, which was equipped with a Probst SG 60 Scissor Grab attachment, serial # 31014910-37-002. The attachment was not secured to the forklift to prevent it from sliding off the forks, on or about June 11, 2013. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: (a) 611 Burnside Avenue, Inwood, NY (Worksite), Material Yard - An employee was operating the Hyster forklift, Model H60 / Serial # D177B44673V, which was equipped with a Probst SG 60 Scissor Grab attachment, serial # 31014910-37-002. The attachment was added to; and used on the forklift, without the prior written approval of the forklift manufacturer. Additionally, the capacity, operation, and maintenance instruction plates, tags, and decals were not changed to reflect the addition of the attachment, on or about June 11, 2013, Note: In addition to abatement certification, the employer must submit abatement documentation for this item in accordance with 29 CFR 1903.19.

The forklift was not marked identifying that an attachment was installed; or with the approximate weight of the truck and attachment combination at maximum elevation with the load laterally centered, on or about June 11, 2013. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
