29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following: On or about June 11, 2013, and the times prior thereto, at or near the worksite located at 523 Kirk Rd in Little Rock, Arkansas, a Hazard Communication Program had not been developed for the benefit of the employees working with and / or near an exposure to hazardous chemicals / substances such as but not limited to Portland Cement, quartz crystalline silica and calcium carbonate contained in the Ashgrove Type N masonry cement being mixed and used by employees while performing masonry tasks including but not limited to brick laying and cutting.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use: On or about June 11, 2013, and the times prior thereto, at or near the worksite located at 523 Kirk Rd in Little Rock, Arkansas, employee unloading brick laying material from a platform elevated by a JLG / Skytrak forklift with telescoping boom was exposed to falling from the elevated platform to the ground surface below.

29 CFR 1926.702(i)(1): Masonry saw shall be guarded with a semicircular enclosure over the blade: On or about June 11, 2013, at the times prior thereto, at or near the worksite located at 523 Kirk Rd in Little Rock, Arkansas, an Essick Concrete Miter saw was available for employees to use to cut brick without the use of a guard. This condition exposed employees to a cutting hazard.
