29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a) NEX Transport, Inc., located at 13900 State Route 287, East Liberty, OH 43319: On or about June 3, 2013, the employer did not ensure that employees, operating powered industrial vehicle such as, but not limited to, Mitsubishi (Model FBS20-48V, Serial # 4HM00248), are competent to complete the task, exposing employees to struck-by, caught in between, and tip over hazards in a case of an unqualified operator not operating a forklift in a safe manner. The employer did not ensure that each forklift operator received formal instructions and practical training on how to operate a powered industrial vehicle, as well as the operator's performance was not evaluated.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
