29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:          a) On or about 06/11/13, on residential construction site at 651 Elmwood Ave.,Buffalo, NY: Employees engaged in roofing work were not trained to recognize potential hazards on this type of jobsite including but not limited to falls from roofs and ladders, electrical hazards, and the need for personal protective equipment. They also were not trained in the applicable OSHA regulations to control or eliminate these hazards.         ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:        a) On or about 06/11/13, on the front side of a house at 651 Elmwood Ave., Buffalo, NY:  Employees walking and standing on the narrow aluminum "pic" of a ladder jack scaffold were exposed to a fall of approx. 8 to 19 ft. to the lower roof or ground while engaged in the tearoff of the old roof. No personal fall arrest system or other fall protection system was utilized.        NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.     a) On or about 06/11/13, on the front side of a house at 651 Elmwood Ave.,Buffalo, NY: Employees were exposed to a fall of approx. 8 to 22 ft. to the lower roof or ground while hoisting themselves up a distance of approx. 3 1/2 ft. from the narrow aluminum "pic" of the ladder jack scaffold to the roof. Direct access to the roof was not provided.     NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):         a) On or about 06/11/13, on the front side of a house at 651 Elmwood Ave.,Buffalo, NY: Four employees engaged in roofing work were exposed to a potential fall of approx. 11 to 22 ft. from the front edge of the roof to a lower roof or to the ground. The pitch of the roof was approx. 9 in 12. No guardrail system, safety net system, or personal fall arrest system was being utilized.         NO ABATEMENT CERTIFICATION REQUIRED
