29 CFR 1926.1101(k)(9)(ii):  Training was not provided prior to or at the time of initial assignment and at least annually thereafter for employees likely to be exposed in excess of a PEL and for employees performing Class I through IV asbestos operations:  (a) GH Phipps Construction Companies, at 200 East Colfax Avenue, Denver, CO: On or about 5/13/13, GH Phipps Construction Companies did not ensure that training was provided prior to or at the time of initial assignment for employees performing Class I through IV asbestos operations.  GH Phipps Construction Companies directed the work of Douglass Colony Group Inc.  Employees of Douglass Colony Group Inc removed copper panels from the Colorado state capitol dome.  Caulking adhered to the copper panels.  The caulking was disturbed during the removal of the copper panels.  The caulking was determined to contain approximately three percent chrystotile asbestos.  This activity was Class III asbestos work.  GH Phipps Construction Companies did not ensure that Class III asbestos work training was provided to the employees of Douglass Colony Group Inc.  This condition exposed employees of Douglass Colony Group Inc to an asbestos hazard.  (b) GH Phipps Construction Companies, at 200 East Colfax Avenue, Denver, CO: On or about 5/20/13, GH Phipps Construction Companies did not ensure that training was provided prior to or at the time of initial assignment for employees performing Class I through IV asbestos operations.  GH Phipps Construction Companies directed the work of Douglass Colony Group Inc.  Employees of Douglass Colony Group Inc removed window trim pieces from the Colorado state capitol dome.  Caulking adhered to the F window trim pieces.  The caulking was disturbed during the removal of the trim pieces.  The caulking was determined to contain approximately four percent chrystotile asbestos.  This activity was Class III asbestos work.  GH Phipps Construction Companies did not ensure that Class III asbestos work training was provided to the employees of Douglass Colony Group Inc.  This condition exposed employees of Douglass Colony Group Inc to an asbestos hazard.
