29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested, or required to use the respirator in the workplace:    (a) National Coatings Inc, at 200 East Colfax Avenue, Denver, CO:  On and preceding 6/10/13, National Coatings Inc did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested, or required to use the respirator in the workplace.  Employees abrasively blasted paint containing lead from surfaces during the reconstruction of the state capitol dome.  Employees abrasively blasting in the containment areas were required to wear Nova 2000 supplied air respirators/abrasive blasting helmets.  The employer did not ensure that all employees were provided with a medical evaluation to determine the employee's ability to use a respirator.  This condition exposed one employee to a respiratory hazard.

29 CFR 1910.134(i)(7):  Oil lubricated compressor(s) used to supply breathing air did not have a high-temperature or carbon monoxide alarm(s) or both to monitor carbon monoxide levels:    (a)  National Coatings Inc, at 200 East Colfax Avenue, Denver, CO: On or about 5/29/13, National Coatings Inc did not ensure that an oil lubricated compressor used to supply breathing air had a high-temperature or carbon monoxide alarm or both to monitor carbon monoxide levels.  Employees of National Coatings Inc used an Ingersoll Rand HP1600WCU-IQ air compressor to provide breathing air for one employee while abrasively blasting paint containing lead from the state capitol dome.  The Ingersoll Rand air compressor was oil lubricated.  The employer did not ensure that the compressor had a high temperature or carbon monoxide alarm to monitor carbon monoxide levels.  This condition exposed one employee to a respiratory hazard.

29 CFR 1926.62(d)(6)(iii):  Where the initial determination revealed that employee exposure to lead was above the Permissible Exposure Limit, monitoring was not repeated at least quarterly until at least two consecutive measurements, taken at least seven days apart, were at or below the PEL:    (a) National Coatings Inc, at 200 East Colfax Avenue, Denver, CO:  On and preceding 5/30/13, where the initial determination revealed that employee exposure to lead was above the Permissible Exposure Limit, monitoring was not repeated at least quarterly until at least two consecutive measurements, taken at least seven days apart, were at or below the PEL.  Employees abrasively blasted paint containing lead from surfaces during the reconstruction of the state capitol dome.  Monitoring during the period March 2012 through June 2012 conducted on behalf of the employer determined employee exposure to lead was in excess of the PEL.  Abrasive blasting resumed in November 2012, December 2012, and May 2013.  Monitoring of employee exposure to lead was not conducted during those periods or at least quarterly.  The employer did not ensure that monitoring was done at least quarterly until at least two consecutive measurements were at or below the PEL.  This condition exposed employees to a lead hazard.
