29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:   The employer does not provide guarding to protect the operator and other employees in the machine area from rotating parts and flying chips.  This violation was observed on or about June 5, 2013, in the Drill Press Area where employees were exposed to a caught-in and struck-by hazard operating the Jet Geared Head Precision Lathe that lacked guarding.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure one or more methods of machine guarding is provided to protect the operator and other employees in the machine area.

29 CFR 1910.215(b)(9): The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch:   The employer does not keep the tongue guards adjusted to one-fourth inch or less from the wheel periphery.        a. This violation was observed on or about June 5, 2013, in the Drill Press Area where employees were exposed to a struck-by hazard when operating the Dayton (110205296) bench grinder that had a 1 inch gap between the right tongue guard and the wheel periphery.       b. This violation was observed on or about June 5, 2013, in the Drill Press Area where employees were exposed to a struck-by hazard when operating the Dayton (42910C) bench grinder that had a 1 inch gap between the right tongue guard and the wheel periphery.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that tongue guards are kept adjusted to no more than one-fourth inch gap.

This violation was observed on or about June 5, 2013, in the Weld Area where employees were exposed to a struck-by hazard when operating a Milwaukee grinder that lacked guarding.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that abrasive wheels are used only on machines provided with safety guards.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:   The employer has determined that voluntary respirator use is permissible, and does not provide the respirator users with the information contained in Appendix D.  This violation was observed on or about June 5, 2013, in the Weld Area where employees where employees wear a 3M brand half-face respirator when performing paint activities.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees that use respirators on a voluntary basis are provided with the information contained in Appendix D.
