29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.    a.  Located at the PDC Steirs Well Pad site in Salesville, Ohio on or about June 12, 2013, the employer, Legend Environmental & Oil Field Service, Inc., did not ensure that its employees received reasonable and necessary instruction specific to the recognition and avoidance of risk factors related to the development of heat-related illnesses such as, but not limited to, heat stroke, heat exhaustion, heat cramps, and heat rash.

29 CFR 1926.602(c)(1)(ii): No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced.     a.  Located at the PDC Stiers Well Pad site in Salesville,Ohio, there were employees hoisting approximately 3,200 pound fracking tank walls by use of a forklift that had a lifting device attached to the forks that did not have an identification tag attached to indicate the lifting device's capacity nor did the employer have written approval from the manufacturer, thereby exposing the employees to a struck-by and/or caught-between hazard.

[44 FR 8577, Feb. 9, 1979; 44 FR 20940, Apr. 6, 1979, as amended at 58 FR 35183, June 30, 1993; 63 FR 66274, Dec. 1, 1998]    29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).    a.  Located at the PDC Stiers Well Pad site in Salesville, Ohio, the employer did not provide training on the operation of the JCB Rough Terrain Telescopic Handler being used to hoist 3,200 pound fracking water tank panels exposing employees to struck-by hazards.

29 CFR 1904.39(a): Basic requirement. Within eight (8) hours after the death of any employee from a work-related incident or the in-patient hospitalization of three or more employees as a result of a work-related incident, you must orally report the fatality/multiple hospitalization by telephone or in person to the Area Office of the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor, that is nearest to the site of the incident. You may also use the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742).    a). On or about June 12, 2013, the employer did not report the fatality of an employee within 8 hours to the Columbus Area Office or the toll free OSHA reporting line.
