Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were potentially exposed to crushing and struck-by hazards from a loss of load while operating an under hung cranes with below the hook lifting devices that were not subject to operational tests or periodic inspections:  (a)  In the mounting department:  On June 11, 2013 and at times prior to; the employer failed to conduct operational tests or periodic inspections of the spreader bar attached to the JET 3 ton underhung crane exposing employees to struck-by and crushing hazards in that the below the hook lifting device was not marked with the rated weight.  (b)  In the metal sheet department:  On June 11, 2013 and at times prior to; the employer failed to conduct operational tests or periodic inspections of the below the hook lifting device attached to the 1/2 ton underhung crane exposing employees to struck-by and crushing hazards in that the below the hook lifting device was not marked with the rated weight .
