29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part: (a) On or about June 14, 2013, at the worksite, a safety and health program had not been initiated and maintained which addressed the following basic elements: 1. Management Commitment and Leadership A. Policy statement: goals established, issued, and communicated to employees. B. Program Reviewed Annually. C. Participation in safety meetings, inspections; agenda item in meetings. D. Adequate commitment of resources. E. Safety rules and procedures incorporated into site operations. F. Management observations of safety rules. 2. Assignment of Responsibility A. Safety designee on site, knowledgeable, and accountable. B. Supervisors' (including foremen) safety and health responsibilities understood. C. Employees adherence to safety rules. 3. Identification and Control of Hazards A. Periodic site inspection program involving supervisors. B. Preventive controls in place (PPE, Maintenance, Engineering Controls). C. Action taken to address hazards. D. Safety Committee, where appropriate. E. Technical reference materials available. 4. Training and Education A. Supervisors receive basic safety and health training. B. Specialized training taken when needed. C. Existence of an employee training program, which is ongoing and effective. 5. Recordkeeping and Hazard Analysis A. 29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system. a. Front Roof Area of the Mountain House: No type of fall protection was utilized when employees were exposed to falls ranging in height from approximately 14 feet to 25 feet while removing the the old existing metal roof panels, removing the thin blankets of insulation and also during the installation of the Titanium Synthetic Roofing Underlayment while on the roof with a slope of 3 in 12 which was approximately 122 feet long and 42 feet from peak to eave as determined on 6-20-13. b. Porch Roof: No type of fall protection was utilized when employees were exposed to falls ranging in height from approximately 13 feet 4 inches to 14 feet while performing roofing activities such as but not limited to removing the old existing roofing panels, removing the thin blanlets of insulation and also during the installation of the Titanium Synthetic Roofing Underlayment while on the 1 in 12 sloped roof which was approximately 122 feet long by 10 feet 7 inches deep as determined on 6-20-13.

Porch Roof: Employees were exposed to falls of approximately 13 feet 4 inches to 14 feet from the eave of the roof deck to the ground and through the openings between the purlins and the rafters which were 15 inches by 46.5 inches to the concrete pad below while installing 4 feet by 8 feet sheets of 7/16 inch thick OSB board for the construction of the 1 in 12 sloped roof deck which was approximately 122 feet long by 10 feet 7 inches deep as determined on 6-20-13. b. Front Roof Area of the Mountain House: Employees were exposed to falls of approximately 14 feet to 25 feet from the edge of the roof deck to the ground and also to the inside through the openings between the purlins and the wood trusses which were approximately 15 inches by 46.5 inches to the concrete floor below while installing the 4 feet by 8 feet by 7/16 inch thick sheets of OSB board for the construction of a small section of the 3 in 12 sloped roof deck which was approximately 18 feet wide at the top section and 38 feet wide at the bottom section as determined on 6-20-13.

Front Roof Area of the Mountain House: Employees were exposed to falls from the edge of the roof framing and also down through the trusses ranging in height from 14 feet to 25 feet to the concrete floor below as they walked the existing 2 inch by 4 inches wide wooden purlins located on top of the wood trusses in order to install the new 2 inch by 6 inch wood purlins as determined on 6-20-13.
