29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: a) On or about 5/30/13 at Greenpac Mill located 4400 Royal Avenue, Niagara Falls, New York; an employee working on the press section of the machine was caught in between the Uhle box and shower pipe when the Uhle box unexpectedly rotated due to work being performed by another contractor. Energy control procedures were not developed for all energy sources, including but not limited to hydraulic pressure, for the press section and basic energy control procedures, including but not limited to removing employeees, were not utilized prior to starting the machine. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.147(d)(3): All energy isolating devices that were needed to control the energy to the machine or equipment was not physically located and operated in such a manner as to isolate the machine or equipment from the energy source: a) On or about 5/30/13 at Greenpac Mill located 4400 Royal Avenue, Niagara Falls, New York; an employee working on the press section of the machine was caught in between the Uhle box and shower pipe when the Uhle box unexpectedly rotated due to work being performed by another contractor. The hydraulic system for the press section was not accounted for when the start up and commissioning group was testing for movement. NO ABATEMENT CERTIFICATION REQUIRED

The employer taksed with start up and commissioning the machine had lock out devices removed for the activation or specific testing of the machine. Employees assigned to perform tasks on top of the press were not notified or removed from the machine prior to activation. NO ABATEMENT CERTIFICATION REQUIRED
