29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a) Roofers were working on an residential roof having a 6 in 12 pitch with exposure to fall hazards up to 16 feet without having received any training from the employer in the proper fall protection methods to be utilized.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a) Located along the front and rear edges of the 6 in 12 residential roof structure, roofers were observed performing roofing associated operatios without conventional fall protection and were exposed to fall potentials of 16 feet.
