OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that Respondent did not ensure that temporary workers performing refuse collection during elevated heat conditions were trained in the health effects associated with, recognition of symptoms, and methods of preventing heat illness: On or about June 5, 2013, a temporary worker who was collecting garbage suffered heat stroke.

29 CFR 1910.151(b): In the absence of an infirmary, clinic, or hospital used for the treatment of all injured employees in near proximity to the workplace, a person or persons was not adequately trained to render first aid: On route at 13023 Afton Meadow Lane, Houston, TX, on June 5, 2013 and times theretofore, employees exhibited heat illness and other injuries and drivers did not have first aid training and adequate first aid supplies to render first aid when an infirmary, clinic, or hospital was not in near proximity.
