29 CFR 1910.134(d)(3)(i)(B)(1) as referenced by 29 CFR 1926.103: The employer did not select a respirator for employee use that maintains the employee's exposure to the hazardous substance, when measured outside the respirator, at or below the maximum use concentration:  a) Brick point work on scaffolding, 181 South Street, Morristown, NJ 07960.     The employer provided 3M N-95 8511 filtering face-pieces for employees exposed to silica when performing brick point work with grinders on a scaffold from 6/17 to 6/18/2013. Employees performing brick point work with grinders on a scaffold were exposed to 15% and 16% crystalline quartz silica for eight hour time-weighted average (TWA) respirable dust exposures of 140 million particles per cubic foot (mppcf) and 240 mppcf, which are 11 and 20 times the permissible exposure limits (PEL) of 12.5 mppcf and 11.9 mppcf, respectively.  Sampling was performed for 365 and 360 minutes respectively on 6/18/2013, with the un-sampled portion of time considered to represent zero exposure for the exposure calculation.  Conditions noted on or about 6/17/2013 and 6/18/2013.
