29 CFR 1926.20(b)(4): The employer did not ensure that the employee(s) required to operate equipment and machinery was qualified by training or experience.     On or about June 9, 2013, at the job site located at 1001 Rochier Ave in Fayetteville, Arkansas, the employer directed employees to operate aerial lifts who were not qualified to do so.  As a result the employees operated the aerial lift on unequal ground and elevated more than 40 feet near an energized overhead power line while exposed to fall and electric shock hazards.

29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means:     On or about June 9, 2012, at the job site located at 1001 Rochier Ave, in Fayetteville, Arkansas, the employer permitted employees to operate an aerial lift within 2 feet of overhead power lines, exposing employees to the hazard of being electrocuted.

On or about June 9, 2013, at the job site located at 1001 Rochier Ave in Fayetteville, Arkansas, the employer did not ensure employees working on the balconies were protected from falls, exposing employees to the hazard of falling from more than 10 feet to the unfinished ground below.
