29 CFR 1926.20(b)(4): The employer did not ensure that the employee(s) required to operate equipment and machinery was qualified by training or experience. On or about June 9, 2013, at the job site located at 1001 Rochier Ave in Fayetteville, Arkansas, the employer directed employees to operate aerial lifts who were not qualified to do so. As a result the employees operated the aerial lift on unequal ground and elevated more than 40 feet near an energized overhead power line while exposed to fall and electric shock hazards.
