29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact. a) Seres-Castle Masonry, Inc. on or about June 18, 2013, at the address of 4121 Monroe St. Toledo, OH: The employer did not ensure employees were wearing appropriate eye protection such as, safety glasses while using a gas power circular saw to cut masonry block. The employee using this tool without eye protection was exposed to potential eye injuries from flying particles.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity). a) Seres-Castle Masonry, Inc. on or about June 18, 2013, at the address of 4121 Monroe St. Toledo, OH: The employer failed to ensure employees were protected from falls while performing overhand bricklaying work from a supported scaffold. Several railing sections were removed/missing from the back edge of the scaffolding platform in which employees were operating. Due to this condition employees were exposed to a 12.5 ft. fall to the ground below.
