29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) At 5019 Cottage Hill Rd. Mobile, AL: On June 18, 2013 and at times prior to; the employer exposed an employee to falls of approximately 18 feet while unloading plywood and carrying it to place on the joists.

29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck: (a) At the work site: On June 18, 2013 and at times prior to; the employer failed to train a powered industrial truck operator, exposing the operator and employees to struck-by and crushing hazards while lifting plywood to the roof of the building under construction.
