29 CFR 1926.150(c)(1)(vi): A fire extinguisher, rated not less than 10B, was not provided within 50 feet of wherever more than 5 gallons of flammable or combustible liquids or 5 pounds of flammable gas were being used on the jobsite: (a) On or about 06/20/13, at the new Auto Zone store under construction at 2590 Ridge Road West, in Rochester, New York, a fire extinguisher was not made available, while an employee was welding high beams using a Bobcat 250 welder generator with a capacity of 12 gallons of fuel. NO ABATEMENT CERTIFICATION REQUIRED
