29 CFR 1926.501(b)(13): 29 CFR 1926.501 (b)(13) Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system: a) On or about 6/19/13, on a residential construction site at 5041 Broadway, Depew, NY: Employees engaged in roofing work were exposed to a potential fall of 7 ft. from the west side of the garage roof. The pitch of the roof was approx. 6 in 12. Two sets of slide guards, one above the other had been installed and ran parallel to the roof edge, but no guardrail system, safety net system, or personal fall arrest system was utilized. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) On or about 6/19/13, on a residential construction site at 5041 Broadway, Depew, NY: Two employees were exposed to a fall of 4 ft. 3 in. when part of an extension ladder was used to access the "pik" of a ladder jack scaffold from the ground. The siderails of the ladder were actually 3 inches BELOW the top of the "pik". NO ABATEMENT CERTIFICATION REQUIRED
