29 CFR 1926.502(b)(2): Mid rails, screens, mesh, intermediate vertical members, or equivalent intermediate structure members were not installed between the top edge of the guardrail system and the walking/working surface when there was no wall or parapet wall at least 21 inches (53 cm) high.     a) South Side of the Site - A superintendent and a laborer were observed using the ramp which was not equipped with a mid-rail exposing them to a 10 foot fall hazard,  on or about 06/17/13.      This contractor is the controlling and correcting employer at the site. The superintendent stated he conducts daily inspections and is continuously monitoring all operations. The superintendent stated in his interview that he corrected observed hazards involving the sub-contractor prior to the inspection. Therefore, he was aware of the operations in progress. This contractor is being cited Under the Multi-Employer Workplace Policy in addition to having exposed employees to this hazard.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:     a) Throughout the Site - A superintendent, foreman and laborers were observed in a building foundation excavation measuring 50 feet by 120 feet where only one egress ramp was installed exposing them to a potential fall hazard, on or about 06/17/13.     This contractor is the controlling and correcting employer at the site. The superintendent stated he conducts daily inspections and is continuously monitoring all operations. The superintendent stated in his interview that he corrected observed hazards involving the sub-contractor prior to the inspection. Therefore, he was aware of the operations in progress. This contractor is being cited Under the Multi-Employer Workplace Policy in addition to having exposed employees to this hazard.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:      a) West Side of the Site - A foreman and laborers were observed in a footer excavation where the spoil was located directly next to the excavation approximately 4 feet in height exposing them to a potential cave hazard, on or about 06/17/13.       b) Center Portion of the Site - Laborers were observed in a footer excavation where the spoil was located directly next to the excavation approximately 4 feet in height exposing them to a potential cave hazard, on or about 06/17/13.      Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.     This contractor is the general contractor for the site, thusly; they are the controlling and correcting employer for the site. The superintendent stated he conducts daily inspections and is continuously monitoring all operations. The superintendent stated in his interview that he was aware of the operations in progress and was observed directing the operations. This contractor is being cited Under the Multi-Employer Workplace Policy in addition to having exposed employees to this hazard.
