29 CFR 1926.502(b)(2): Mid rails, screens, mesh, intermediate vertical members, or equivalent intermediate structure members were not installed between the top edge of the guardrail system and the walking/working surface when there was no wall or parapet wall at least 21 inches (53 cm) high.   a) South Side of the Site - A superintendent and laborers were observed using the ramp which was not equipped with a mid-rail exposing them to a 10 foot fall hazard,  on or about 06/17/13.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:   a) Throughout the Site - A superintendent and laborers were observed in a building foundation excavation measuring 50 feet by 120 feet where only one egress ramp was installed exposing them to a potential fall hazard, on or about 06/17/13.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    a) West Side of the Site - A foreman and laborers were observed in a footer excavation where the spoil was located directly next to the excavation approximately 4 feet in height exposing them to a potential cave hazard, on or about 06/17/13.     b) Center Portion of the Site - Laborers were observed in a footer excavation where the spoil was located directly next to the excavation approximately 4 feet in height exposing them to a potential cave hazard, on or about 06/17/13.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
