OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by vehicular traffic:    a. On June 21, 2013, an employee was working from an articulating boom Genie aerial lift while performing tree trimming activities. The aerial lift was partially blocking the South bound lane of the street, and there was no traffic control zone set up. Employees, working on the ground, removing limbs and brush from around the roadway, were exposed to a struck-by vehicular traffic hazard.

29 CFR 1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.    a. An employee was operating a chainsaw from an articulating boom aerial lift without chaps or cut resistant clothing; exposing the employee to an amputation hazard.

29 CFR 1910.135(a)(1): The employer shall ensure that each affected employee wears a protective helmet when working in areas where there is a potential for injury to the head from falling objects.    a. Employees were working on the ground below the foreman who was working from an Aerial lift cutting limbs from a tree, the limbs would then fall to the ground exposing employees to a struck-by hazard.
