OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck-by hazards: a) At the worksite, 1100 Capitol, Houston, Texas, on June 20, 2013, the employer had designated a Southwest Synthetic Sling for use as a rescue harness for rescue when such use was prohibited by the manufacturer.

1910.269(c): The employer did not ensure that the employee in charge conducted a job briefing with the employees involved before they started the job covering hazards associated with the job, work procedures involved, special precautions, energy source controls, and personal protective equipment requirements: (a) At the worksite, 1100 Capitol, Houston, Texas, on June 20, 2013, the job briefing did not adequately cover personal protective equipment requirements in that employees were not required to wear face shields, fire-resistant pants, and fire-resistant neck protection.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a) At the worksite, 1100 Capital, Houston, Texas, on June 20, 2013, employees working inside the vault were not required to wear protective gear for the face, neck, and legs. Employees were exposed to fire and explosion hazards from an arc blast explosion.
